PLEASE NOTE WE ARE A TOWNHOUSE COMPLEX GOVERNED BY BODY CORPORATE BYLAWS. THESE BYLAWS OVERRIDE THE RESIDENTIAL TENANCY LEGISLATION. SO APPROVAL OF ANY PET/S TO BE KEPT WITHIN THIS COMPLEX MUST BE APPROVED BY THE BODY CORPORATE COMMITTEE OF THE COMPLEX. THEIR DECISION WILL BE FINAL AND THEY ARE NOT REQUIRED TO GIVE REASONS FOR NOT APPROVING A PET/S

PLEASE NOTE IF YOU ARE APPLYING FOR A CAT OR DOG AND YOU DO NOT SUPPLY THE REQUIRED COUNCIL REGISTRATION NUMBER AND PROOF OF REGISTRATION, CURRENT VACCINATION CERTIFICATE AND MICROCHIP NUMBER THE PET WILL AUTOMATICALLY NOT BE APPROVED. THIS IS THE STANDARD MINIMUM REQUIREMENT OF THE BODY CORPORATE OF THE COMPLEX AND THEY MAY REQUEST FURTHER INFORMATION TO BE ABLE TO MAKE THEIR FINAL DECISION

APPLICANT'S DECLARATION & AGREEMENT OF TERMS & CONDITIONS

The tenant acknowledges that this is an application to keep pet/s on the premises and does not guarantee that approval will be given. *

The tenant acknowledges & agrees that not only does the owner need to give approval of this application to keep pet/s on the premises, the application has to be approved by the Body Corporate of the complex. *

The tenant agrees and acknowledges that applying for a pet/s in a complex that is governed by Body Corporate Bylaws - the owners response is overridden by the Body Corporate of the complex and the Body Corporate of the complex is not required to give a reason for their decision. *

The tenant agrees and acknowledges that they must not keep a pet/s on the premises prior to gaining approval from the Body Corporate of the complex. Doing this is a breach of the Body Corporate Bylaws and your tenancy agreement and a breach notice will be issued without exception and you will be required to remove the unapproved pet/s immediately. *

The tenant agrees that no additional pet/s will occupy the premises even temporarily under this agreement. Any pet/s other than the approved pet/s specified in the General Tenancy Agreement and this Pet Agreement must first be requested by the tenant in writing via a separate pet application giving full details and then be approved in writing by the Body Corporate of the complex PRIOR to the pet/s being allowed onto the Premises. Pet approval may be subject to specific criteria and must be complied with. Approval is NOT guaranteed. *

The tenant accepts full responsibility and indemnifies the lessor/agent for any claims by or injuries to third parties or their property caused by, or as a result of actions by their pet/s and regardless of the approval status. *

The tenant has inspected the property and is satisfied that the fencing is adequate for the confining of the pet. The tenant further acknowledges that the lessor/agent neither expressly nor implied warrants the suitably of the fencing. The confining of the pets/s is at the tenant’s sole discretion. *

The tenant further agrees to unilaterally indemnify the lessor/agent from any and all liability in relation to the actions of the pet/s including but not limited to the tenant’s pet escaping the property and causing. loss, damage, injury, or costs to any other party. *

No pets are to be on common areas of the property. On leaving your townhouse all pets must be on a suitable lead or enclosed carry case. Any accidental soiling on common property must be immediately cleaned up and disposed of. Failure to do this will result in a breach notice for breaching Body Corporate by-laws. *

The tenant agrees that should the animal become annoying, bothersome and in any way a nuisance to the local authority, neighbours or any other body, the tenant will upon request from the Agent/Body Corporate of the complex, immediately remove the pet/s from the premises permanently. *

The tenant agrees to have the carpet/flooring professionally cleaned or assessed any time during the tenancy should the Lessor/Agent be concerned about damage, odour or animal stench and believes it may permanently damage the carpet or flooring. *

The tenant/s agree any damage caused by the pet/s is not considered fair wear and tear and tenant/s must rectify any damage to the premises or inclusions caused by the pet/s at the tenants cost. *

The tenant agrees to arrange and pay for flea fumigation inside and outside of the Townhouse at the end of the Tenancy or at any time during the tenancy as required or requested by the Lessor/Agent. It is to be carried out by a licenced & insured pest control company complying with Australian Standards. A copy of the receipt and pest control advice risk management record (listing treatment details & chemicals used) is to be provided to management. *

The tenant agrees that any damage caused to the lawns and or garden caused by the keeping of pet/s shall be the responsibility of the tenants to rectify the damage as directed by the Lessor/Agent. This may involve re mulching the back garden and replacing plants as directed. Further the tenant agrees that any animal faeces are regularly cleaned up (at least weekly) and any rubbish thrown around by the animal is also picked up. *

The tenant/s agree to not leave food for their pet/s outside their dwelling where it may attract other animals or vermin. *

Litter trays must not be placed on balconies and must be cleaned and replenished daily. *

The tenant agrees if the pet is a cat - it is to be keep inside the townhouse at all times, day and night - as per the Moreton Bay Regional Council regulations. *

If the pet is a dog the tenant agrees to restrain or remove the dog from the premises for the duration of inspections arranged by the agent with the required notice given. *

The tenant agrees not to breed or allow the pet/s to reproduce. *

The tenant/s agree if they keep fish they accept responsibility for any damage due to leakage or spillage of water. *

The tenant agrees and acknowledges that on approval by the owners the terms of this application become an express term of the tenancy and as such become effective and binding on the tenant. If approved, you are acknowledging this application will form part of the General Tenancy Agreement which includes additional terms related to the pet/s and tenant’s responsibility. *

The Tenant Agrees and acknowledges that if approval is given by the Body Corporate the following conditions will apply:-
1. Approval under this by-law is for specific animals and does not apply to visiting, substitute or replacement animals, which must be individually approved by the body corporate;

2. The animal must be kept within the lot or a fenced exclusive use area, and must not be permitted to roam on the common property or other lots;

3. The animal must be restrained on a leash (or other suitable restraint) in control of a responsible person at all times whilst on the common property;

4. All animals, if required by law to be licensed or registered, must be licensed or registered and the pet owner must provide evidence of such registration or licensing if requested by the committee;

5. If the animal is a dog or cat, it must wear a collar at all times;

6. The animal must be kept in good health and free from fleas, ticks and other parasites;

7. If the animal is diagnosed with fleas or other similar parasite, or another communicable disease, it must immediately be removed from the scheme land and not return until the parasite or communicable disease is removed, to minimise the risk of transfer to the lot, common property and other occupiers and animals;

8. The animal must be restrained from making noise sufficient to disturb the enjoyment of the lots and common property by other occupiers;

9. The animal and occupier must comply with all other by-laws;

10. The occupier must ensure that any mess or soiling from the animal is immediately cleaned up and disposed of appropriately so as to not cause a nuisance to other Occupiers or persons lawfully enjoying the lots or the common property;

11. The lot owner and occupier acknowledges that he or she is absolutely liable to each other owner and occupier and their respective guests and invitees, for any unreasonable nuisance, noise or injury to any person, or damage to property caused by that animal;

12. The animal must not be left in the lot unsupervised for more than 18 consecutive hours;

13. If the body corporate is satisfied that there is a persistent contravention of these conditions, the body corporate may give notice in writing to the occupier that the animal must be permanently removed from the lot and common property
